US National Interest Exception (NIE) Eligibility Criteria

If you’ve been present in China, Iran, India, Brazil, South Africa, the Schengen area, the United Kingdom or Ireland over the past 14 days, you can only enter the USA if:

  • You’re a US citizen (or close family member of a US citizen)
  • You’re a US Green Card holder (or close family member of a US Green Card holder)
  • Neither of the above situations apply to you but your travel purpose is permitted under Presidential Proclamations and you’ve been issued with a NIE certificate

Permitted travel purposes include:

  • Seeking to provide vital support or executive direction for critical infrastructure
  • Traveling to provide vital support or executive direction for significant economic activity in the United States
  • Journalists and other media and media support activities
  • Sportspeople and entertainers, including their support teams
  • Students and certain academics covered by exchange visitor programs
  • Immigrants
  • Fiancé(e) of any of the above

These restrictions are set out in Presidential Proclamations (PPs) 9984, 9992, 10143, 10199.

‘Close family member’ typically means a spouse or civil partner (providing you reside in a country that views civil partnership as akin to marriage), unmarried children or step-children under the age of 21 and unmarried siblings under the ageof 21. You only need to apply for an NIE if you already hold a valid US visa or electronic travel authorisation (ESTA)

No, when you apply for your US visa you’ll automatically be considered for an NIE at the same time. If your visa is issued, you’ll also be issued with an NIE.

No, as you’ll either already hold a US visa (and have therefore already enrolled your biometrics) or have an ESTA (and aren’t required to enrol your biometrics) you don’t need to enrol your biometrics to make an NIE application.

Your reason for being in the US to conduct work activities must satisfy one of the eligibility criteria for an NIE.

For example, if you need to perform maintenance on a specialised piece of equipment, such as an oil platform, it’s highly likely you’ll be issued with an NIE.

Similarly, if you’re a technician supporting a major band, tour group or media agency covering a US-based event, you’ll likely be issued with an NIE.

However, if your client simply ‘prefers’ that you conduct your work activities in person in the USA, that’s unlikely to qualify you for an NIE by itself.

You can always apply for an NIE and see what happens but there’s no guarantee you’ll be successful.

In general, UK-based customers are protected by the Consumer Contracts regulations 2013 and have the right to cancel and get a full refund within 14 days of booking an appointment. However, if your appointment is booked within 14 days, you must waive your right to cancellation under these regulations so that we can provide you with the NIE service.

Outside of these regulations, if you request to cancel your appointment two or more business days prior to it taking place, you will be entitled to a full refund.

After this time, cancellation charges will apply.

If you’re entitled to a refund, you can claim it by submitting a refund request online. We’ll process your refund within 14 calendar days, however depending upon your payment card operator it may take longer for the funds to appear in your account.

We’ll only refund money to the same card or account used to make the original payment.
